NJ BANKRUPTCY 911

(201) 673 – 5777

Someone recently asked whether they could file for bankruptcy if they had a criminal record.  The short answer is yes.  However, there are some debts that may be related to the criminal charges that may not be wiped out in a bankruptcy.

For example, if you were convicted of shoplifting 10 years ago and paid any related fines and/or restitution then that would not cause any problems in a bankruptcy case.  However, if you caused the death or personal injury to someone as a result of a DUI/DWI then debts related to that case whether you were charged criminally or not would not be dischargeable.

You should consult with an attorney related to your individual case so she can address any questions you may have to your specific situation.   The information in this post relates to all states as the US Bankruptcy Code is a Federal Law.
